TERMS AND CONDITIONS OF SUPPLY

This page (together with the documents referred to on it) tells you the terms and conditions on which we supply any of the products (Products) listed on our website www.rocnoir.co.uk (our site) to you. Please read these terms and conditions carefully before ordering any Products from our site.

1. INFORMATION ABOUT US

1.1 We operate the website www.rocnoir.co.uk. We are Roc Noir Skiwear Limited, a limited company registered in England and Wales under company number 07265789. Our registered office is at (the “Registered Office”) C24 Parkhall, 40 Martell Road, Dulwich, London SE21 8EN. Our VAT number is 10874502.

2. HOW THE CONTRACT IS FORMED BETWEEN YOU AND US

2.1 After placing an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been dispatched.

3. CONSUMER RIGHTS

3.1 You may cancel an order at any time within seven working days, beginning on the day after you receive the Products. In this case, you will receive a full refund of the price paid for the Products in accordance with our Returns Policy (set out in clause 7 below).

4. AVAILABILITY AND DELIVERY POLICY

4.1 All products displayed on our site are available and in stock unless otherwise stated.
4.2 All deliveries to a UK address are free for orders over £25. Orders under £25 will be charged at £2.50. A postage paid return slip will also be provided.
4.3 Deliveries to the European Union and Norway (excluding skis) will be charged at £15. The international delivery of skis will be charged at a flat rate of £40. Due to technical issues we are unable to provide free returns outside the United Kingdom.

5. RISK AND TITLE

5.1 The Products will be at your risk from the time of delivery.
5.2 Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.

6. PRICE AND PAYMENT

6.1 The price of the Products and our delivery charges will be as quoted on our site from time to time, except in cases of obvious error.
6.2 Product prices include VAT unless otherwise stated.
6.3 Product prices and delivery charges are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.
6.4 Payment for all Products must be by credit or debit card. Payment is taken using World Pay which is fully secure and encrypted.
6.5 If you order Products from our site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

7. OUR RETURNS POLICY

7.1 If you are not 100% satisfied with your purchase you may return it for exchange or refund within 30 days of receipt of your order, provided it has not been used and is still in its original packaging. For all orders delivered to a UK address a postage paid returns slip will be provided (this will not apply in the case of skis where we will arrange a courier for returns). To cancel an order, you must inform us in writing. You must also return the Products to us as soon as reasonably practicable. You have a legal obligation to take reasonable care of the Products while they are in your possession. This provision does not affect your other statutory rights as a consumer.

8. LIABILITY

8.1 Skiing and other mountain activities can be hazardous and we strongly advise that you undertake appropriate training before using the Products you purchase from us. You acknowledge that it is your responsibility to ensure that the Products are compatible with your intended and actual usage of the Products. An order cannot be cancelled or returned if you ask us to fit bindings that require the skis to be drilled. When requesting bindings to be fitted you must tell us the correct boot length and mounting point. We are not responsible if inaccurate information is provided. We are unable to set the forward pressure or the DIN setting of the bindings. This must be done by a qualified ski technician. We accept no liability if you do not do this. You expressly confirm that following receipt of the ski bindings from us, it is your sole responsibility to ensure that such Products are correctly fitted and set at an appropriate DIN setting.

9. TERMS AND CONDITIONS

9.1 We reserve the right to revise and amend these terms and conditions from time to time.

10. LAW AND JURISDICTION

10.1 Contracts for the purchase of Products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
